DMCA takedown notice for shared-mime-info DB
Someone has been issuing DMCA takedown notices through Github for this repo https://github.com/zRedShift/mimemagic/ and its forks (and I happen to have one such fork and being on the receiving end of this DMCA notice https://github.com/pombredanne/mimemagic/).
Here is the GitHub link: https://github.zendesk.com/attachments/token/eTJTaIjPp5pqbcAldaowe2N4E/?name=2021-03-22-freedesktop.rtf
Based on https://github.com/zRedShift/mimemagic/issues/4 I assume that @hadess is the person that is behind these legal actions.
I would like to discuss here and in public both the substance and the form of this DMCA notice which is a serious formal legal action in the US.
-
On the form, is this an action that has been discussed among committers, maintainers and the freedesktop group somehow?
-
On the substance, there are several complex legal licensing issues that the claims in this legal action bring up wrt. the GPL, the MIT license, GPL compatibility, mere aggregation, derived works, GPL license of data vs. code, etc. on so many levels. I have started to list some elements in this gist https://gist.github.com/pombredanne/7d6b3689a1b796c9a509c83b6b87f274
In my fork, I added some files including the full original distros of this project 1.10 release in https://github.com/pombredanne/mimemagic/commits/master
